Terms of service

Last updated: 15 October 2026

These terms cover your use of UpHeron at upheron.com, its API, MCP server and status pages (the "service"). The service is provided by Symelo LTD, a company registered in Bulgaria, VAT number BG207464756, ul. Makedonia 66, ap. 51, Plovdiv, Bulgaria ("we", "us"). By creating an account or using the service, you agree to these terms. Our privacy policy explains how we handle personal data.

1. Your account

  • Give accurate details and keep your sign-in and API tokens safe. You are responsible for what is done with your account and its tokens.
  • If you use the service for an organisation, you confirm that you may accept these terms for it.
  • You must be at least 16 years old.

2. Acceptable use

Monitor only websites, servers, domains, email setups and repositories that you own or are allowed to monitor. Do not:

  • use the service to overload, attack or probe systems you are not authorised to test;
  • get around plan limits, rate limits or security measures;
  • publish unlawful, misleading or infringing content on status pages;
  • send spam or unwanted messages through alert channels;
  • resell the service without our written agreement.

We may pause monitors or suspend accounts that break these rules. We tell you first, unless we must act at once to prevent harm.

3. Plans and payment

  • The Free plan costs nothing. What each plan includes, and its price, is on the pricing page. We may change what the Free plan includes, with notice.
  • Paid plans are paid in advance for each billing period through our payment provider and renew until you cancel. When you cancel, your plan stays active until the end of the period you paid for, then moves to the Free plan.
  • We announce price changes at least 30 days ahead; they apply from your next billing period.
  • Monitors that AI agents pay for follow the payment terms in our docs. Payments are processed by Stripe.
  • Payments are not refunded, except as described here or required by law.
  • Consumers in the EU may withdraw from a paid plan within 14 days of buying it by writing to [email protected]. Because the service starts at once at your request, we refund what you paid minus the share for the days already used.

4. The service

  • We work to keep the service running and accurate, but we do not promise that it is never interrupted, that it detects every outage, or that every alert arrives on time. Checks can fail or be wrong because of networks, websites that block automated requests, or the third-party services alerts go through.
  • Vulnerability alerts rely on public databases and on the software versions we detect or you give us. They can be incomplete or wrong and are not a security audit.
  • We may change, add or remove features. We give reasonable notice before a change that significantly reduces what a paid plan includes.

5. Your content

You keep all rights to what you add: monitor settings, status page text, software lists and the rest. You allow us to store and process it to provide the service. Status pages you publish are public. If you add other people as alert contacts, make sure you may give us their details.

6. Liability

  • Nothing in these terms limits liability for intent or gross negligence, for death or personal injury, or where the law does not allow it to be limited.
  • Otherwise, our total liability is limited to what you paid us in the 12 months before the claim, and we are not liable for indirect loss, lost profits or lost data.
  • If you are a consumer, you keep all rights that the law of your country gives you and that cannot be waived.

7. Ending the agreement

You can stop using the service and ask us to close your account at any time by writing to [email protected]. We may end these terms with 30 days' notice, or at once if you seriously break them. When your account closes, we delete your data as described in the privacy policy.

8. Changes to these terms

We may update these terms. We tell account holders about material changes by email at least 30 days before they take effect. If you do not agree, you can close your account before then; using the service after that date means you accept the new terms.

9. Law and disputes

These terms are governed by Bulgarian law. Disputes go to the competent courts in Plovdiv, Bulgaria. If you are a consumer, you also keep the protection of the mandatory law of the country where you live, and you may bring a claim in its courts.
